40R vs 40B

There were a couple of questions sent to us about why the low income apts at MarketStreet were advertised as 40R. The Town Manager, Bill Gustus provided the following answer.

"They are listed as 40R units because they were permitted under G.L. Chapter 40R. Per the statute, 25% of the units must be "Affordable" using the standards of affordability set out under G.L. Chapter 40B. So, the short answer is, they are the same as 40B units.

Since all 180 units are rental units, they all count towards our affordable inventory even though only 45 units are in the affordable category. Now that National has pulled building permits for the housing development and when added to our other affordable inventory, we now have an affordable inventory of over 11% and are thus immune to additional 40B development until at least 2020."
