Planning Board Meeting Summary

#1 and 3 the most interesting

#mapoli #lynnfield At times tonight it felt like the movie “The Star Chamber”. Tonight’s planning board meeting met on the following three items dealing with Market Street

1. Application for Minor Modification Phase II The chairman, John W. Faria, asked if the members if the application met the five criteria and then asked for a vote to approve. When people asked what they were voting on we were told it was on file in the Planning Board office and we could review it there and that the procedure is that they only can discuss if it meets the five conditions. They did not have to discuss the content of what they were voting on. There was discussion about National filing the document on July 31 but people only receiving notice of the meeting on Monday Aug 26th. In the end the Planning Board voted 5-0 to approve the minor change without giving a hint on what they approved. The chairman did agree that he will think about how to inform citizens about when documents come in. In my 35 plus years of attending government hearings I have never seen anything like this. Someone will go down and look at the documents and let us know what was approved.

2. The Application for Approval Not Required (ANR) was approved with little discussion, because the Planning Board said it was a formality

3. The third and final segment dealt with Signage and shimmering wall. The revolved around the design standards and the King’s Bowling sign in particular. The Planning Board consultant explained that under the design standards, there are currently two Buildings, Whole Foods and King’s Bowling where the town has little control over the signage. The shimmering wall that appears to be part of the sign is actually part of the wall and not subject to signage control.

There is a Planning Board meeting that you may want to attend Wed evening., as it deals with Market Street and request for changes to the zoning by law.

The last time a minor modification was allowed, the street size went from approximately 40 ft to 120+ft.

Selectmen meeting Summary

August 19, 2013

Interesting Selectmen’s meeting this evening. Key items:

1. In discussing lnoise and traffic at Market Street one neighbor poiinted out”It isn’t just the neighbors, it is about the town”.

2. The chief of police said that at times traffic may be “onerous and overwhleming”, but the town will take steps to mitigate it. This will may happen even with only Phase 1 opening. Phase 1 is only 56% of the square footage being developed.

3. In discussing noise, the town administrator, Bill Gustus, pointed out that the development agreement states that “3.10 Noise. Noise from loudspeakers or amplified sound from special events within the Traditional Neighborhood Village Sub-District shall not exceed 9dB as measured at the Project’s property line without the approval of the Board of Selectmen. ” 9 decibels is silence, so at walnut street property line there should be silence.

Construction working past 7:00

August 18, 2013

It is a little late now but we sent a note to the Town Administrator Bill Gustus about the work that is being done after 7:00 PM when the development agreement states it should end at 7:00 PM. He said that the developer pointed out that the agreement says "exterior work" and the work now being done is interior. He did say that if we notice or hear exterior work being done we should contact him and he will have the building inspector act on it.

This appears to be similair to the design criteria where sentences have "should be" instead of "shall".

Another number to remember – 56%

In addition to 81%, being the % of the Town Meeting that voted not to have a cinema here is another number to remember. 56%

Several people asked about the Phase 1 and Phase 2 referred to in a recent North Shore magazine artcile and story in the Patch. The Town Administrator confirmed that there are two phases and that the first phase that is being completed is only 275,000 of the total of 495,000 sq ft of retail and office space that has been approved. So when the development is fully operational in the next few months we will only be seeing 56% of the traffic and other effects.
